Can the Senate prevent the President from essentially running the executive? Can they refuse all appointments to departments and the cabinet?

they're not permanent appointments, though.
I'm fairly certain they'll overturn the "can only happen during recess" bit. the other is up in the air but considering Kennedy is a pro-executive justice, I think it leans towards overturn.
