1. DOMA is from 1996, not the 1800s.
2. DOMA doesn't allow the 50 states to determine gay marriage, DOMA prevents recognition of gay marriage at the federal level even if a state recognizes it.

If all 50 states allow gay marriage, DOMA still pevents federal acknowledgement. Kind of a big deal when it comes to estate tax and general income taxes.

If a state allows gay marriage, the feds should recognize it. By not, it's denying the state it's say. It is not staying out of it, it is an active participant. Staying out of it would be abiding by each state's laws.
