It's not supposition at all. It was ruled cruel and unusual by a court once, and then reversed. However three of the judges which held with the majority to reverse have went on record stating they made the incorrect decision. It's a legal error that we still have capital punishment, and even a cursory glance at the legal standard established for it's use makes it clear it's employed in a completely unconstitutional manner today (and always has been). A vast majority of legal scholars will tell you even by the 4 elements outlined by the court as necessary for permitting the use of capital punishment, not a single one is met today and vast volumes of statistical data definitively show they have not been met.
Quite frankly you are ignorant on the subject which is why no one expects a substantive response from you on the issue.
