That's a silly point, Galt. The consequences of an action play a large role in determining the soundness of that action. For instance, is drinking a liter of water per hour the same as drinking a liter of Hungarian moonshine? Why would they be evaluated differently, with one viewed as normal, and the other as a problem?
Similarly, sitting in prison sucks, but it is better than being murdered by the state. You don't come back from death, you can't be compensated for it, so it is obviously a much bigger issue.
The idea that it makes more sense to focus on the total efficacy of the justice system is nothing more than a deliberate distraction, intended to perpetuate a barbaric practice. The same tactic is used in re: black lives matter. You always get some conservative white dude going "We should focus on the criminal justice system, not blacks." Meanwhile nothing changes, and that's the entire point of the fallacy.
