I think the animals have more of a right to not be subjected to cruelty than religious groups have a right to cultural expression.

I'm inclined to agree with you. Religious rights have tended to be curtailed where they are harmful, and I think causing such pain must be considered harmful. I would support such legislation here.

Does it really make any difference? I dont think there's a way for people to test whether an animal was killed kosher or halal anyway, if I were these abattoir owners I would just kill them any which way and label the meat as I see fit.

I think the state has the right to legislate practices in slaughterhouses that sell meat to the public. I do not think they have the right to legislate how a particular individual slaughters and animal meant for their own consumption. So if one wants slaughtering done in a particular way for religious reasons, do it yourself.
