Can it be appealed? Would SCOTUS grant this case a writ? I imagine SCOTUS would give them a smack down.

It'll still come to a vote right? What's wrong with the court granting a vote even if it didn't have the number of signatures needed? I'd see a problem with them denying a vote given enough signatures, but not them granting a vote with too few.
