The Federal Land Policy and Management Act of 1976 is a statutory law that supersedes common law, and quite explicitly ends the homesteading principle.
Hilariously, this was adopted to end abuse of homesteading by corporations... But no doubt Dharma will try to portray it ad an act of oppression.

Common law also recognizes adverse possession ie squatters rights. This land isn't being used by one one claimant but the other claimant's family homesteaded and put this land to original use.
So it is clear which claim is on stronger footing according to the principles of both stautory and common law.
Lawyers will decide this, unfortunately federal courts are totally corrupt kangaroo courts so it could go either way.
