Here is the crux of the issue: it seems blatantly unconstitutional but how can anyone challenge it's constitutionality? The only person who would have standing is technically dead.
"The President, through the Attorney General, may authorize electronic surveillance without a court order under this subchapter to acquire foreign intelligence information for periods of up to one year..." - 50 U.S.C. § 1802

There is something very dystopian about using a brain dead woman to produce children against her will. Let's not forget that the fetus was without oxygen for just as long as it's host was. There is a good chance that it will be born disabled as a result. This woman was only 14 weeks into her pregnancy too; it's not like this child was only a couple of days away. She'll be kept alive for almost 6 months against her and her husband's will in order to produce a potentially retarded child that the father does not seem to want. Apparently in Texas, fetuses have more rights than women.
