if martin felt threatened by zimmerman following him he could have instigated it. note: you can follow people in this world, it's not "instigation" of anything to follow someone, threatening or not. i don't think that's an unreasonable explanation:

martin eludes zimmerman because he realizes martin is following him
martin attacks zimmerman because he gets the jump on him because he's trying to figure out why he's following him. martin likely was just looking to beat him up or something, obviously that escalated quickly though
