Obama's Gun Control Changes

Going ahead and starting a thread since this will be revealed today.
LOTS of people on Facebook are now concerned that Obama will be overruling the 2nd with an Executive order - some have even go so far as to say "If he can do this, he can repeal the 22nd!"
Guess we'll see just how good/bad things are a bit later.

Executive Orders are fine if they are internal in nature. What I mean by that is if the EO directs Department A to do re-organize in this way, or take over this responsibility from Department B, is fine. It has to be within the confines of existing law.
But EOs can't extend the power of the Executive Branch. That's just flaunting the voters.

Personally I think it's going to be a combination of beefing up background checks by making them more comprehensive and facilitating states to be able to share data better. Talk about identifying mentally ill individuals and helping the mental health system deal with them. IDK if he will go as far as ending sales directly between individuals, but he might.
I also see an end to all magazines that hold more than 10 cartridges.
He'll talk about having congress re-institute the assault weapons ban and make the identifying traits easier to follow (less confusing). He won't do it unilaterally and we know congress won't do it, but he'll throw it out there.

If the changes are reasonable, such requiring a background check through a FFL licensed dealer for every transfer I'm all for it. Trying to target law abiding citizens by banning certain classes of weaponry or magazine are an insult to the principles this country was founded upon and should be dismissed out of hand as foolishness.

And what test will be used to ban the mentally ill? The Briggs Meyer personality test isn't based on objective evidence. What conditions specifically will be cause one to lose their rights?
I don't think the ban on mentally ill using a gun is possible. Much of the field is subjective, exact diagnosis doesn't exist. Also if you look at the stats the mentally ill are among the least violent. There's just not much objective justification going on with this idea, it sounds good to a lot of people but when you look at the technical aspect you run into trouble.
If the government can arbitrarily declare someone to be mentally ill and suspend their rights that's going to be problematic and that's all there is to that.
