Can't share ebooks? What are you on about? My mom, uncle, and grandparents all have Nooks and they share ebooks with each other quite often.
The system isn't perfect but Apple isn't part of the law and if there's a problem, they aren't the ones to try and fix it - its not their job. No ifs, ands, or buts about it. And lets be honest, Apple's ONLY interest in this was Apple - not anything else.

There's some dumb stipulations on it but it can be done (once).
Apple didn't do anything at all to benefit the consumer. They tried to eliminate price competition - not exactly consumer friendly actions. You can't look at the "future" on something like this and if it "may" have fixed a problem because we don't know what is going to happen 5 years down the road. Its not Apple's place to try and do something like that. Its against the law, and for good reason.
