What's the argument that delaying implementation is unconstitutional? I can't find a cogent one I keep finding jibberish written by tea partiers.

A delay still sounds like something the judiciary would defer to the executive on to be honest.
One commentator of questionable credibility said that companies have to take certain steps to enjoy the delay, so this is effectively a new law that is without congressional backing. That makes more sense, but on the other hand the law is still in effect so it's not a usurpation of congressional power. But it arguably might be an overextension of executive power.
Dunno. I'd be interested to read a serious article on this but can't really find one still.
