Maybe that is what it says, Bill. I don't see anything about apartments, but I doubt they'd be that specific in the ruling.
Either way, this is a proper role for the Fed. It is interstate commerce. Transmissions are made in one state, and beamed to another. That's clearly a Fed purview.
However, notice that the FCC specifically said that it WON'T interfere if there are legitimate health or safety concerns? It's acknowledging that, in some instances, state/local rights take precedence even when the overall issue is in the Fed domain.
