Freedom of association doesn't apply to associating to plan or participate in criminal acts. At that point it becomes conspiracy... Further, there are already lots of restrictions on gathering for unlawful purposes.
It would not be a constitutional issue. Well, it might, but that is because the US Supreme Court just rules however it feels like on a particular day.
