if she was unable to tell if it was, or at the time she knew it was rape, then it was rape. if at the time she didn't think it was rape, but thought so the next day when she sobered up, it's not rape. innocent until proven guilty, she has to prove she knew it was rape at the time of the rape (or unable to tell if it was, meaning, she was blacked out intoxicated). for his defense if he himself was drunk and unable to remember, assuming that the male is the "rapist" is sexist
