Regardless of how they phrase it, that is what happened. They just walked in and took it. If Washington had done the same to some piece of land, it similarly wouldn't have changed its status as capital.
The law has been modified to include East Jerusalem. So...even if they don't want to call it an annexation...it effectively is. There is a legal basis for their exercise of sovereignty over it, regardless of the careful wording of politics.
Not that any of this matters of course, since they established their capital in Jerusalem in 1949, long before any of this. That they hadn't got around to unifying the city yet doesn't matter in the slightest.
