The Probate Judge is an elected constitutional officer of the county. Just like the Sheriff, Clerk of Court and Tax Commissioner. Marriage licenses have to be issued by the probate court judge. This doesn't mean he or she has to physically issue each one but it must be done under his or her authority.

No if a judge refused to comply with citizens (again not seeing how that really applies to these probate judges) I would call them activist shitlibs.
The difference between Alabama and PA that I apparently have to spell out for you is that in Pennsylvania when the federal courts overturned the marriage ban they accepted it and let gay people marry, while in Alabama they refused to because of their deep seated bigotry.
