Federalism, Constitutional Convention and New Amendments

Allowing the states to override the Supreme Court is a terrible idea. Same with the idea of requiring a supermajority to invalidate the law. Actually to be honest most of these suggestions seem like an obvious attempt to push a particular agenda instead of setup an equitable system.

For once I am happy of political gridlock in the US, since it means none of these amendments will be added to the constitution.

I don't like any of them, only the first one is even close. Number 2 is just plain stupid, and would cripple the US both economically and militarily. Number three, four and nine are basically calling for complete deregulation, which would be a disaster. Number five would end protections for a lot of minorities. Number 6 would make it easier to pass laws violating other parts of the constitution. Number seven would try to turn the clock back a few hundred years, and leave a millions without access to critical services. Number eight would lead to anarchy, with everyone trying to second guess each other, and lawsuits all over the place.

A great way to turn the clock back on civil development, I suppose. Might be fun if shattered hellscape is what your into.

Fstar, I used to be more sympathetic to "leave it up to the states"...but just imagine how quickly the south would regress into depravity if not being dragged along, just barely keeping its nose and eyes above the surface of the 21st century, by the rest of us. Sure, it would be fun for a few people who would start making a lot of money really easily, but the people actually do deserve better. "Leave it up to the states" is just code for "use government to strong-arm it". We have to create a baseline somewhere...as opposed to letting entire states slide into the dark ages over ideology.

It's been pretty interesting seeing how many "patriots" don't hesitate to abandon America--in some cases, literally--when the Party is not in power or the Feds do something they disagree with.

I'm guessing if we go down this road eventually there will be a suggested amendment to reinstate segregation.

yeah its 3/4ths majority of states can do an amendment. he's basically proposing an amendment to make a 2/3rds be necessary to keep a law that amends the constitution but not really.

but no dylan, if 7 really works as it does today then there wouldn't be a national effective drinking age, there wouldn't be illegal drugs from the feds, there wouldn't be the healthcare act, there wouldn't be social security, there wouldn't be a standing army such that we have........... the list is immense of how much the feds oversteps its legal authority. and while much of it i want destroyed (like for example social security, which i think is wrong for any just government to do because it creates moral hazard), i must be a pragmatist and say we can't at this point.
