So today we had one of the guys that litigated the Apple Samsung case (for apple) come into class and walk us though a separate but similar case. Long story short, patent litigation is not nearly as arbitrary or clear cut as you would think. This guy is one of the top IP litigators in the country and he was of the very strong opinion that juries actually do a great job in coming to the right conclusions on even the most complex patent issues, which surprised me. The $1B verdict, which was a jury one, won't be overturned because no one is actually questioning whether or not samsung infringed on apples patents (that is pretty obvious as eric showed).
That said I still think this decision is nonsense. Obviously samsung's phone sales penalize apples sales to a certain degree. To argue anything otherwise is simply twisting the facts and the law to avoid an inconvenient outcome.
