I've posted the actual patent that Apple filed. It says that it's for an electronic device, with the following design. Then they have 9 pictures of a rectangle with rounded corners and a screen. It's quite literally a 4-page patent. The official PDF is linked. How can you still say that they didn't patent a rectangular phone?
Just because they didn't sue Nokia is meaningless. They could have. But, they chose not to. They chose to sue the maker who was most competitive with them.
If you copied the latest Stephen King book and started selling it on the street, would it still be illegal even if King doesn't sue you? If you kill someone but the police don't charge you with a crime, is it still illegal?
