They could just put it in and see if it works, then it should be good to go. Who or how is somebody going to hack into a Nintendo DS game, and go to the 45th level of obscure game XYZ in case the child gets there with violent porn or something?

I think you guys are probably missing the main concern: piracy. A used game can very well be pirated, and that would mean not only potential legal problems but also having to pull the game away from the kid if a publisher voices concern.
