Speech is not regulated. There are certain types of speech that are not protected, however, there also has to be some harm that has come from that speech to even bring the question of law into things.
So if we were to compare apples to apples, we would be discussing how someone used their gun in a way that wasn't protected an the legal consequences that individual would face.

Inaccurate. For example commercial speech is heavily regulated. You cannot swear on public television (for the most part).
Not all defamation actions require harm to be shown.
