homo is a group classification(genus), human almost universally refers to homo sapien with some controversy if that includes neanderthals. unless one is translating homo into human for the sake of convenience. aside from that brief wiki description i've never seen any ancestral human referred to as human, only by their sub-species name (homo-whateverus)

They're the same species as us because we can interbreed. Legally the kid would the a normal child of the mother and that is who would probably have custody.
