I think exploited needs to realize that US laws are not in effect outside of the US or its territories. You cannot be prosecuted for a US crime outside of the US. Now, with some crimes, traveling abroad (and using a passport, a Govt issued document) might be a crime if you leave the country to go commit a crime such as underage sex in another country, but you can't actually be prosecuted for the sex itself, only for going there to do it.
And our constitution does not define war crimes, where did that come from? Talking about our constitution in regards to shooting bin Laden....where does our constitution define that? It might be against some international rules of war, but it has nothing to do with our constitution.
And for the record, nowhere in the constitution does it say that congress must declare war, or that the words "declaration of war" must be used with any hostilities. In fact, with regards to the Iraq war, congress did pass a resolution that authorized the use of military action against Iraq. That means the war was totally legal, that's a war, nowhere does it say the words "declaration of war" must be used to define war. A "military action" against a country is war, and that was passed by congress in 2002.
