Agreed, there is no provision in the Constitution that empowers any branch to suspend the Constitution or Constitutional rights of any citizen for any reason. Rights may only be removed through due process.

The only "loophole" is that the right to Habeas Corpus may be suspended during rebellion or invasion (and no, a couple guys with bombs is neither of those things)

The reason you have a constitution and the legal framework that surrounds it is to ensure that politicians can say things like this but are stopped from actually doing anything about it. It's something that was intentionally written into the system.

I can't help feeling they are only saying it to appear tough on national security, but even if they do mean it then it is something that the US system is designed to cope with.

Advocating it is not a big deal, so long as they can't actually do it.

Looks like his oath to protect the constitution is worthless.

He should be impeached. The fact is Congress are so entirely incompetent that a significant percentage of the population thinks the 112th Congress should be disbanded.

There is more than one petition to this effect circulating.

Well, from a practical standpoint it doesn't really matter. The government has been captured by forces that are inimical to the principles this nation was built on.

You can't even say their principle is that of the free market because that simply doesn't exist. The fact is our government has adopted regressive practices at the behest of private capital, in order to maximize profits.

Conclusion:

Nationalize the financial sector, the insurance sector, and the healthcare sector. These industries will remain functionally useless until their fiduciary duty is to actually serve human need rather than maximize profits for private entities to profit by.
